1. Introduction & Agreement

Welcome to AuraShades ("we," "us," "our"). We provide premium, handcrafted sunglasses, prescription eyewear, and related services. These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("the Customer," "you") and AuraShades. These Terms govern your use of our website (the "Site"), your purchase of our products (including custom prescription lenses), and your use of any of our services, such as the Virtual Try-On tool. By accessing our Site or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety.

2. Eligibility

To purchase products or services from AuraShades, you must be at least 18 years of age and possess the legal authority and capacity to enter into a binding contract. You affirm that all information provided to us during the registration and checkout process is true, accurate, current, and complete.

3. Customer & Client Responsibilities

You, the Customer, agree to provide and maintain current, complete, and accurate information for your account and any orders placed. This includes your full name, a valid email address, a correct shipping address, and accurate payment information.

For Prescription (Rx) Orders: It is your sole responsibility to provide a valid, current, and accurate optical prescription issued by a qualified eye care professional. You warrant that the prescription information you submit is correct. AuraShades is not responsible for any issues arising from inaccurate or expired prescription information provided by you. We recommend a comprehensive eye exam every one to two years.

4. Products, Orders & Availability

Placing an order through our Site constitutes an offer to purchase our products. An order is deemed confirmed only upon your receipt of an official order confirmation email from AuraShades. All products are subject to availability. As many of our frames are crafted from natural materials like bio-acetate, slight variations in color, pattern, and finish may occur, which is a hallmark of their unique, artisanal quality. We reserve the right to limit the quantities of any products or services that we offer and to discontinue any product at any time.

5. Pricing, Billing, and Payment

All prices are quoted in the currency displayed on the Site and are subject to applicable taxes and shipping fees, which will be clearly itemized at checkout. Full payment is required at the time of ordering. For custom prescription orders, payment is required before the order is sent to our optical lab for production. We reserve the right to change prices for products displayed on the Site at any time.

6. Delivery & Shipping

All delivery and shipping timeframes provided are estimates. Production time for prescription lenses may add an additional 7-10 business days to the standard shipping estimate. While we partner with reliable carriers, we are not liable for delays caused by factors beyond our reasonable control (e.g., carrier delays, customs processing, severe weather). Our obligation is to deliver your order to the address you provide. Title and risk of loss for all products pass to you upon our delivery to the carrier. We are not responsible for orders that are undeliverable or misdelivered due to incorrect information provided by you.

7. Returns, Warranty & Cancellations

Our policies are designed to ensure your satisfaction while accounting for the custom nature of some of our products.

• Non-Prescription Products: We offer a 30-day return policy for all non-prescription sunglasses. Items must be in their original, unworn condition with all packaging intact to be eligible for a full refund or exchange. You can initiate a return through our online portal.
• Prescription (Rx) Products: Due to their custom-made nature, prescription glasses are final sale and cannot be returned for a refund. However, if you have any issues with the prescription accuracy or fit, please contact us within 30 days of receipt. We offer a one-time complimentary remake to correct any defects or ensure the prescription is right.
• Warranty: All AuraShades frames are covered by a 2-year manufacturer's warranty against defects in materials and workmanship. This warranty does not cover scratched lenses, damage from accidents, or normal wear and tear. Warranty claims are assessed on a case-by-case basis by our support team.
• Cancellations: You may cancel a non-prescription order before it has been shipped. Prescription orders may only be cancelled within 24 hours of placement, before they enter production at our optical lab.

8. Intellectual Property

The "AuraShades" name, logo, website design, text, graphics, photography, unique frame designs, product model names (e.g., 'The Vesper', 'The Helios', 'The Orion'), and all other brand materials ("Brand Assets") are the exclusive intellectual property of AuraShades and are protected by international copyright, trademark, and trade dress laws. We grant you a limited, non-exclusive, non-transferable license to access our Site for personal, non-commercial use. Any unauthorized use, reproduction, or distribution of our Brand Assets is strictly prohibited.

9. Limitation of Liability

To the fullest extent permitted by law, AuraShades' liability for any claim arising out of your order or use of our services shall be limited to the total amount you have paid to us for the specific order in question. In no event shall we be liable for any indirect, incidental, special, or consequential damages. Our non-prescription sunglasses are designed for UV protection and are not safety glasses intended for impact protection. Our prescription eyewear is crafted based on the information you provide; we are not liable for issues arising from incorrect self-submitted prescriptions. We are not responsible for events of Force Majeure, including but not limited to acts of God, natural disasters, or other circumstances beyond our reasonable control that may disrupt service.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law principles. In the event of any dispute arising from these Terms or our services, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.

11. Policy Updates

We reserve the right to update or modify these Terms & Conditions at any time without prior notice. The revised Terms will be posted on our Site, and the "Last Updated" date will be amended. Your continued use of our services or placement of an order after any such changes are posted constitutes your acceptance of the new Terms.
